Most lawyers take a contingent fee (percentage of your settlement) ranging from 1/3 to 40%, depending on the nature of your case. However, at the Brad Bradshaw Law Firm, we only take 25% of the settlement in car, motorcycle and semi-truck (commercial vehicle) cases that are settled early . Even if the case is tried our fee in these cases never exceeds 1/3. We have a history of really good results and that allows us to charge less than many other lawyers and firms.
It varies by base, but in many cases it’s two years. However, there are exceptions to many rules and you should consult or hire a qualified Hawaii lawyer as soon as possible.
That’s a good question, but it is tricky. I say tricky because it varies depending on the type of case and there are exceptions in some situations. So there is no broad all encompassing rule, but very generally speaking Hawaii has a two year statute of limitations, such as for car wrecks. However, legal malpractice is 6 years. And there are special rules for medical malpractice, which in many situations, with some explanations that is beyond the scope of this Q&A, is two years. Bottom line, if you have a real or potential case. Consult a qualified Hawaii licensed attorney as soon as possible.

(There is a joke between lawyers about inexperienced/unsuccessful lawyers…”Yes, he settled the case for a million dollars, but it was worth three million.”) The answer to that question is how good is your lawyer. Lawyers who have been successful at trial and know how to work up a case properly can translate, or leverage, that past success in to a win for you in your current case and a maximum settlement.
You should hire a lawyer based upon two primary questions:
1) What is there trial experience/results, and
2) What is there fee?
The better their experience and results, the more likely a bigger recovery, and the lower their fee, the more money net in your pocket.
The amount of time you have to make a personal injury claim is actually called the statute of limitations. It varies by state, but in Hawaii for many cases, generally speaking, it is two years. Yes. If you have a valid claim, you should make one. Insurance companies charge insurance premiums for a reason. And they are making money. If you fail to make your valid claim, you are in essence allowing them to make more money and actually pocket money that should go to you.
